GENERAL TERMS AND CONDITIONS OF SALE

General Conditions
These present conditions govern the sales rules between VIVEROS GUZMAN, S.L.U. and the buyer, from the purchase, order and up to the services, including payment and delivery. These general terms and conditions of sale are brought to the knowledge of each buyer to enable them to process an order in this establishment, thus excluding any other condition.

Prices
Unless expressly agreed otherwise, all prices are ex-works, excluding packaging or loading manipulations. The value-added tax in the corresponding legal amount, as well as all other taxes, fees, tariffs or other levies at the time of delivery/provision, are borne by the buyer. The same is valid for packaging costs, freight and transport insurance costs.

Payment
Unless otherwise agreed, the agreed price must be paid in cash from the moment of shipment or delivery of the goods. The maximum cash sale amount will be established by the provisions in force at the time of sale. Cheques, transfers and other types of deferred payment will only be accepted by the selling party under special agreement and only for payment reasons. If the buying party is delayed in payment, the selling party may charge them default interest corresponding to the percentage of the legal interest rate of public debt on the date of calculation, increased by one and a half points.

Commercial Risk
Our companies reserve the right to accept the order subject to approval of the risk by our credit insurance company if a payment method other than cash is agreed.

Right to Claim
Your satisfaction is our main goal and you can exercise the right to claim in the following cases:
For purchases directly in-store, the following must be taken into account:
• Returns will not be accepted after fifteen days from the date of the ticket or invoice, nor within that period if the original ticket or invoice is not presented, and if there is a reason for return, the item must be in good condition, in its original packaging, along with all accessories.
• No plant returns will be accepted under any circumstances.

For orders sent to your address, if you are not satisfied when you receive your merchandise, you can exercise your right to claim.

For us to accept your return, the following conditions must be met:
• You must make the claim in writing within a maximum period of 3 calendar days from the date of delivery.
• If there is a reason for return, the item must be in good condition, in its original packaging, along with all accessories.

Claims not communicated within the established period and form will not be taken into consideration under any circumstances.

Force Majeure
The appearance of unforeseeable circumstances or circumstances beyond the control of the parties, especially all cases of force majeure, authorize the seller to extend the deadlines and delivery dates according to the duration and volume of these circumstances and their consequences, without granting the buyer a right to terminate the contract or compensation for damages. However, the seller is also authorized to cancel the entire or partial order when these circumstances arise, without the buyer having any right to compensation.

Place of Litigation
In the event of a dispute, the courts of MALAGA will have jurisdiction.
